Out of respect for your right to privacy and in concern for the security of your personal data, Poli-Farbe Czechia s.r.o., Jindřišská 941/24, 110 00 Praha 1 – Nové Město, IČO: 248 75 775, DIČ: CZ24875775, registered in the Commercial Register maintained by the Municipal Court in Prague, File No.: C 443290, share capital: CZK 10,000, (hereinafter referred to as the “Owner” or the “Controller”), acts as the owner and administrator of the portal “Dekoratorium Partner” available under the domain partner.dekoratorium.com and its sub-sites (hereinafter referred to as the “Website”), as well as the controller of personal data collected and processed in connection with the operation of the Website.

In addition, the following entities act as joint controllers of personal data:

  1. Poli-Farbe Slovakia s.r.o., Račianska 88B, 831 02 Bratislava, IČO: 57 495 220, DIČ: SK2122814210, registered with the Municipal Court Bratislava III, Section: Sro, Insert No.: 197082/B, share capital: EUR 5,000
  2. Śnieżka Trade of Colours Sp. z o.o. with its registered office in Warsaw (code: 00-867), ul. Chłodna 51, for which the registration files are kept by the District Court for the capital city of Warsaw in Warsaw, 13th Commercial Division of the National Court Register, registered in the Register of Entrepreneurs of the National Court Register under KRS no.: 0000373430, NIP (tax ID): 8722387389, REGON (business ID): 180632944, BDO (waste database): 000499445, share capital of PLN 303,558,000.00,

(hereinafter jointly referred to as the “Joint Controllers”).

The Controller and the Joint Controllers apply appropriate technical and organizational measures to ensure the protection of your privacy and the security of your personal data.

This Privacy Policy explains how we use, collect and store your personal data. By using the Website, you consent to the practices described in this Privacy Policy.

We collect your personal data provided during your use of the Website with the greatest care and in accordance with the applicable legal provisions, that is the Data Protection Act of 10 May 2018 and the Regulation of the European Parliament and of the Council (EU) of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR), with respect to your right to privacy, and we guarantee to all persons using the Website that the data provided will be properly protected against interception by third parties.

We take special care to protect your interests and, in particular, ensure that we collect your data for designated legitimate purposes and do not subject it to further processing incompatible with those purposes. We take care to ensure that your data is correct and relevant to the purposes for which it is processed and is kept for no longer than is necessary to achieve the purpose of the processing.

1. Who is the Privacy Policy aimed at?

Poli-Farbe Czechia s.r.o. pays particular attention to the privacy of users using the Website. If you use the “Dekoratorium Partner” website under the domain partner.dekoratorium.com, this Privacy Policy is addressed to you.

3. What data do we collect and for what purposes?

If you visit the Website, we automatically – by means of cookies – collect IT data about your visit, in particular:

  • a) IP address,
  • b) type of operating system,
  • c) browser type.

Other data is collected voluntarily in other ways, e.g. by telephone, fax, email, written declaration (in the case of the granting of rights to the “Dekoratorium Partner” website to Users in accordance with the provisions of the Rules of the partner.dekoratorium.com website), when using the functionalities of the Website. Data collected using these means include:

  • a) full name,
  • b) email address,
  • c) telephone number,
  • d) address of residence or delivery,
  • e) business details
  • f) login
  • g) the data necessary for the processing of a complaint.

The personal data of the Account Users in the form of full name, telephone number and email address, who are employees of the Client and for whom it is necessary to set up an Account in order to exercise the rights connected with the use of the Account (as persons authorised by the Client), are provided to the Company by the Client.

We may collect your personal data and subsequently further process it for the following purposes:

  • a) responding to your enquiries (if you have called or written to us asking for a quotation and/or requesting the preparation of a quotation)
  • b) marketing of our own products (if you are our Client, we may process your data for marketing purposes within the framework of our so-called legitimate interest, on the same basis we use remarketing tools based on cookies, otherwise our marketing activities are based on your consent);
  • c) handling complaints;
  • d) creating and maintaining an Account;
  • e) processing of your order made through the Website;
  • f) performance of contracts concluded between the Company and the Client;
  • g) assertion of claims relating to the Contract between the Company and the Client;
  • h) complying with legal obligations and archiving documents, including those relating to the conclusion of a transaction;
  • i) keeping statistics

4. What is the legal basis for the processing of data collected?

In the case of the processing of data for the purpose of maintaining an Account, processing orders, providing you with invoices and other documents, concluding contracts in documentary form, handling a submitted complaint, the legal basis for the processing is the performance of the contract for the provision of electronic services, the sales contract or other contracts (e.g. 6(1)(b) of the GDPR).

In the situation of processing for the purpose of responding to correspondence sent by you, the legal basis for the processing is our legitimate interest (Article 6(1)(f) of the GDPR) consisting of providing our clients and users with full information on the products offered by Poli-Farbe Czechia s.r.o.

In the case of processing your data for marketing purposes, including, in particular, informing you about products offered by Poli-Farbe Czechia s.r.o., promotions, discounts, additional services, sending (displaying) advertisements tailored to your preferences, the legal basis for data processing is our legitimate interest, i.e. Article 6(1)(f) of the GDPR), which includes presenting you with offers, promotions, advertisements that may be of interest to you, as well as other information concerning our activities.

Similarly, in the case of processing your data for analytical, statistical, security purposes on the Website, we rely on our legitimate interests (i.e. Article 6(1)(f) of the GDPR) to provide a user-friendly, attractive and secure website and to optimise it in order to achieve both our business objectives and to meet your expectations.

In the event that you make potential claims against us or we make claims against you, the legal basis for the processing of your data is our legitimate legal interest (i.e. Article 6(1)(f) of the GDPR) in asserting or defending against claims.

When we process your personal data in the form of cookies and other similar technologies for marketing purposes, to send you advertisements tailored to your preferences, to analyse your activity, to improve relevant functionalities and for statistical purposes, we do so on the basis of our legitimate interest (i.e. Article 6(1)(f) of the GDPR), subject to your consent to the use of cookies, in accordance with the provisions of the Telecommunications Act.

Your data will also be processed in order for us to comply with our legal obligations under Article 6(1)(c) of the GDPR, e.g. the obligations set out in tax law.

In the case of the processing of personal data of the Client’s employees or representatives, their personal data is processed by the Company on the basis of the legitimate interest, which is the performance of commercial contracts with Clients.

5. Duration of retention and processing of your data.

If you send us an enquiry, your data will be stored and processed for the period of time necessary to respond and resolve your problem.

If you make an order, your data is stored and processed until the legal obligation obliging us to process your data ceases (Accounting Act, tax law), as well as when the possibility of asserting claims related to the contract concluded by Poli-Farbe Czechia s.r.o. by either party ceases. Data of employees or representatives of the Client is processed by the Company for the duration of the contract between the Company and the Client and for the period of the statute of limitations for claims related to the contract.

In the event of a complaint, we will store and process your data until we have resolved your case, but not beyond the expiry of the statute of limitations for claims under applicable law.

In the case of the processing of personal data for marketing purposes, your data will be processed until you object and, in the case of marketing based on cookies, until you withdraw your consent to the use of cookies.

Remember that you can write to us at any time at partner.dekoratorium.com to have your personal data deleted.

6. To whom is your personal data transferred?

If this is necessary for the purposes of the processing, your data may be transferred to other entities. Such transfers can only take place with our consent, on the basis of a concluded contract and only to those who ensure that your data will be adequately protected and processed in accordance with the law. These entities process the data provided on our instructions and on our behalf. This means that your personal data is transferred:

  • a) to the company that operates our Website,
  • b) to the hosting provider who maintains the Website on its servers,
  • c) to the IT company that maintains a backup website,
  • d) to delivery companies,
  • e) to companies marketing our Website,
  • f) to law firms if we take action to protect or assert our claims,
  • g) to payment operators

Your personal data, in specific situations, i.e. in connection with interaction with global companies such as Google Inc. may be transferred outside the European Economic Area. In the case of the above entities, including in the case of our use of Google Analytics systems, data is transferred based on the relevant contracts. These contracts are based on the standard contractual clauses issued by the European Commission in accordance with Article 46(2)(c) of the GDPR.

7. Access to your personal data and your rights.

Remember that you have the right to access your personal data at any time. You can obtain a copy of the personal data we hold about you free of charge.

You can also always get information from us on:

  • a) the purpose of processing your data,
  • b) the type of data we process,
  • c) the person/entity we share your data with,
  • d) the time we plan to keep your data for,

You have the right to:

  • a) rectification of your data,
  • b) erasure or restriction of your data if we no longer need it for the purposes for which you provided it to us, or if you have withdrawn your consent to its processing or object to the processing of your data for marketing purposes.

You can also object completely to the processing of your data for marketing purposes.

8. Final provisions

Your personal data is not processed by automated means and is not subject to profiling.

The principles set out in the Privacy Policy are subject to Slovak law.

You can always lodge a complaint about our handling of your personal data. The complaint is submitted to the Úrad na ochranu osobných údajov Slovenskej republiky.

Cookies policy

1. What are cookies?

The Website does not collect any information automatically, except for the information contained in cookies.

Cookies are IT data, in particular text files, which are stored in the Website User’s terminal equipment and are intended to make it possible to use the Website. Cookies usually contain the name of the website from which they originate, the length of time they are stored on the terminal equipment and a unique number.

The entities responsible for placing cookies on the User’s terminal device and for accessing them are primarily Poli-Farbe Czechia s.r.o., as well as Poli-Farbe Slovakia s.r.o. and Śnieżka Trade of Colours Sp. z o.o., together with the entities described below in this Cookie Policy.[SP4.1]

2. How is personal data collected by automated means?

Cookies make it possible for us to remember and check your preferences. For example, this allows us to: improve your search results, ensure the relevance of the information you display.

Cookies do not make any modifications or changes to the settings on your equipment or the software that has been installed on your equipment.

Please note that you have the right not to consent to our use of a particular type of Cookies from the banner to manage cookies when you first log in to the Website. Consent is not required for the use of cookies, which are essential for the Website operation.

The data collected automatically by means of Cookies will be used by us to analyse User behaviour and collect statistical data. If you do not consent to the installation and use of cookies for these purposes, please tick the relevant consents on the cookies consent banner that is displayed when you first access the Website or change your browser settings. In the case of cookies that we use for analytical purposes and that have been created by third parties such as Google – Google Analytics cookies – we use anonymisation and pseudonymisation of the personal data that may be contained in these cookies. In this way, your personal data is not transferred to Google so that it can identify you from the cookies obtained.

Cookies are used for:

  • a) adapting the Website content to the User’s preferences; in particular, these files make it possible to recognise the User’s equipment and appropriately display the Website and adjust it to the User’s individual needs;
  • b) compiling statistics which help us to understand how Users use the Website, so that we can improve its structure and content;
  • c) maintaining the User’s session (after logging in), so that the User does not have to re-enter their login and password on each page.

3. What type of Cookies are used on the Website?

The Website uses two main types of cookies: “session cookies” and “persistent cookies”. “Session” cookies are temporary files that are stored on the User’s terminal equipment until the User logs out, leaves the website or switches off the software (web browser). “Persistent” cookies are stored on the User’s terminal equipment for the time specified in the parameters of the cookies or until they are deleted by the User.

Furthermore, we can divide cookies according to the following criteria:

a) the necessity of providing the services:

  • I. indispensable – they are absolutely necessary for the proper functioning of the Website or the functionalities the user wishes to use – they do not require the User’s consent,
  • II. functional/preferential – they serve to ensure a high level of functionality of the Website; without the settings saved in cookies the level of functionality of the Website may be reduced, but this should not prevent the complete use of the Website; they collect information on the User’s preferences and enable us to remember the language and other local settings and adjust the Website accordingly – they require the User’s consent,
  • iii. statistical – collect information on the User’s activity on the Website and enable optimisation of its functioning, in addition they may help to identify inconveniences or problems, as well as demonstrate the effectiveness of the advertisements used; the use of these cookies makes it possible to track patterns of use of the Website by many Users, and not only individual visitors – statistical files which do not process personal data do not require the User’s consent,
  • IV. marketing – used to customise the advertising content displayed to the User, so that advertisements displayed both on external websites and on the Website are tailored to the User’s preferences in terms of choice of services, based on data held by the operator; the User has to give their consent to the use of these cookies;

b) files origin:

  • I. own – cookies placed directly by the owner of the Website
  • II. external – cookies placed by external parties whose website components have been triggered by the owner of the Website;

4. What third party cookies do we use and how do these cookies work?

Google Analytics (cookies) – analysis of website statistics

Google Analytics uses “cookies” technology to enable analysis of traffic sources and how visitors use the Website.

Google collects the data obtained from the placement of cookies on your equipment on its servers and uses this information to create reports and provide other services relating to traffic and Internet usage.

Google may also transfer this information to third parties where it is required to do so by law or where such third parties process the information on Google’s behalf.

This data only serves as material for statistical analysis and system error correction mechanisms, therefore, the data from the cookies is not combined in any way with other data you provide us with.

5. Final provisions

The Website Operator informs you that restrictions on the use of cookies may affect some of the functionalities available on the Website.

Information concerning the processing of personal data for persons entitled to represent and participate in the contract performance.

In connection with the cooperation with Poli-Farbe Czechia s.r.o., Registered office at: Jindřišská 941/24, 110 00 Prague 1 – Nové Město (hereinafter: “We” or “Controller”), we would like to inform you that Poli-Farbe Czechia s.r.o. is the Controller of your personal data. The following affiliated entities also act as joint controllers of your personal data: Poli-Farbe Slovakia s.r.o. and Śnieżka Trade of Colours Sp. z o.o.

For what purpose and on what basis do we process your personal data?

We will process your personal data on the basis of the law, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereafter referred to as: “GDPR”, for the following purposes:

  1. 1) In order to pursue the conclusion or performance of concluded contracts if you are a party to such a contract (legal basis: Article 6(1)(b) of the GDPR).
  2. 2) if you are a representative/associate of an entity with which we cooperate, your data is processed on the basis of Article 6(1)(f) of the GDPR, where the legitimate legal interest is the correct performance of the contract between us and your employer/principal and the contact regarding the cooperation. In this case, if you do not contact us directly, your data may have been transmitted to us by the entity you represent/cooperate with;
  3. 3) to enable email contact with us (its employees and associates) and to undertake contact with addressees, as well as to document arrangements made with business partners via email on the basis of Article 6(1)(f) of the GDPR, where the Controller’s legitimate interest lies in the correspondence and the ability to demonstrate the arrangements made in the course of the correspondence;
  4. 4) to document the contracts concluded and their billing on the basis of the provisions of tax law, the provisions of the Accounting Act (legal basis: Article 6(1)(c) of the GDPR in connection with the relevant provisions in the field of tax law and accounting);
  5. 5) for the purposes of internal organisational and administrative activities to ensure the smooth running of our organisation, on the basis of our legitimate interest pursuant to Article 6(1)(f) of the GDPR.
  6. 6) to establish, assert or defend against claims in pursuit of our legitimate interest and for archival purposes (legal basis: Article 6(1)(f) of the GDPR).

We would like to inform you that the provision of personal data is voluntary, but necessary for the exchange of correspondence and the performance of the contract. Failure to provide data will result in the impossibility of electronic communication and the conclusion of the contract.

Who will we share your personal data with?

We may transfer your personal data to other recipients entrusted with the processing of personal data on behalf of and for the benefit of the Controller, including companies from the Śnieżka Capital Group (Fabryka Farb i Lakierów Śnieżka S.A., 00-867 Warsaw, ul. Chłodna 51, and ŚNIEŻKA Trade of Colours Sp. z o.o., 00-867 Warsaw, ul. Chłodna 51) to Sales Representatives, to entities providing consultancy services to us and to entities with whom we have concluded a contract for the provision of maintenance services for the IT systems used by us. Your personal data may furthermore be shared with law firms providing legal assistance to us. Your data will also be made available to authorised public administration bodies.

Your data will not be transferred to third countries or international organisations.

How long will we process your personal data?

Your personal data will be processed by the Controller for the duration of the performance of the contract between the parties, for the period of the assertion of possible claims, i.e. 3 years from the date of termination of the contractual relationship between the parties, as well as for the purposes of archiving and accounting as defined by specific regulations such as tax law and the Accounting Act (in the case of accounting records – 10 years).

What rights do you have?

  • · the right to access your personal data and to receive a copy of the personal data being processed;
  • · the right to rectify your inaccurate data;
  • · the right to request the erasure of data (right to be forgotten) in the event of the circumstances provided for in Article 17 of the GDPR;
  • · the right to request the restriction of data processing in the cases indicated in Article 18 of the GDPR;
  • · The right to object to the processing of data in the cases indicated in Article 21 of the GDPR;
  • · the right to portability with reference to data provided, processed by automated means, where the legal basis for the processing is consent or the performance of a contract;
